Everything You Need to File Your Mutual Consent Divorce
If you live in Maryland and want to get a divorce on mutual consent grounds, there are a number of documents you are going to need to be sure to file with the court:
1) Civil Domestic Case Information Report - This form (CC-DCM-001), which can be found on the court website, must be completed with basic information about the parties and the proceeding.
2) Complaint for Absolute Divorce - A template for your complaint can be found in the court forms at CC-DR-020. Make sure to fill this form out completely, including requests for all of the relief you are seeking.
3) Separation Agreement - For a mutual consent divorce, you must file a signed agreement that resolves all issues regarding property and alimony. If minor children are involved, the agreement must also resolve legal custody, physical custody, and child support.
4) Child Support Guidelines Worksheet - If child support is addressed in your divorce, you must include a completed worksheet (form CC-DR-035).
5) Answer - The other spouse must file an answer to the complaint.
6) Joint Request for an Uncontested Hearing - In many counties, you must also file this joint request to get your uncontested hearing onto the calendar.
